Yuzu is Dead! Here Comes Suyu! A “New” Nintendo Switch Emulator...Will Nintendo Sue?

This is a follow up video to last weeks video: Nintendo has killed Yuzu and Citra emulators. Nintendo Switch emulation at least on the Yuzu emulator front is gone and 3DS emulation on Citra went with it! So let's take a look at the Nintendo lawsuit, find out why Yuzu lost and talk about what this means for game emulation moving forward! Because Suzu emulator is here...a new Nintendo Switch emulator that does basically everything DIFFERENT than Yuzu Emulator for Nintendo Switch did. Will it be enough to keep Nintendo's lawyers at bay?

Yesterday news broke that Nintendo is going after the Yuzu Emulator claiming it's illegal and in violation of Nintendo Copyright...which is not suprising because last February I said this was coming and soon! SO let's take a look at Yuzu Emulation, Nintendo Switch emulation and whether or not Nintendo has a legal case to stand on! Because Nintendo is trying to say Yuzu circumvents certain technologies and Nintendo wants Yuzu shut down by the courts! No Surprise...it is Nintendo after all! Nintendo news except NOT positive!

and before this : One year ago I did a video on Nintendo going after Valve and Steam in regards to the Dolphin Emulator and retro gaming emulation in general...and in that video I told you Nintendo was going to end up going hard against video game emulation! Some people didn't believe me...so let's look at the newly updated Nintendo Game Content Guidelines! oh and the competitive Smash Bros Tournament Guidelines are insane too...but that isn't what this is about!

I asked, you answered...and I try to listen :) Of all the requests for new content on the channel one of the most frequently asked for videos is a series on the Steam Deck.

About eight months ago I did a part 1 video on whether video game emulation / emulation setup guides were legal and I mentioned I thought Nintendo would challenge this moving forward...and they did by removing the Dolphin emulator from Steam. Thankfully I have a long background in copyright and intellectual property law, have taught it to college students and have used this knowledge in many aspects of my working life as a filmmaker and professional athlete manager.

And on October 25th Nintendo went even WEIRDER with their new content guidelines rules! So today we will be talking about the concept of why video game emulation is legal in the first place and why Nintendo's new rules are just seriously insane!

But this will be very interesting to follow as if this goes to a court case it COULD be decided in Nintendo's favor and what emulation of retro gaming hardware as we currently know it could be in serious legal jeopardy!

Nintendo distributed a Switch title that used an open source GBA emulator, but that release did not credit the author of the emulator or provide source code.
The situation was solved by crediting the author and providing the source for download.

Nintendo cannot claim emulation is used for piracy while simultaneously distributing titles that use emulation software.

Saying an emulator is illegal because people could use it to play illegally downloaded games is like saying VLC or any media player is illegal because people could use it to watch illegally downloaded movies.

Tested suyu on android and PC, so far its basically just a rebrand, although they have the Nintendo menu feature that wasn't available in yuzu. Will definitely keep an eye on it to watch its development.

I said it before... The way Nintendo and the big companies are handling these cases is completely wrong. Trying to hit Emulators and ROM sites, is like cutting the hydras head... You cut one, two more will grow! If they have used a friendly and polite way (absorbing the team for example, like SEGA did with Sonic Mania) they would not have the backlash from the community and most people will like their approach.

Yuzu flew way to close to the sun. I hope this is a lesson to other emulation teams. I dont think there is a problem with having a Patreon but there is a problem with charging for a service to patch your emulator to place a game 2 weeks before release. Very dumb move on their part

I personally backed up about 60 of my Switch games. I really should be able to do whatever I damn well please with what I personally own, encryption be damned. It's just as stupid as warranty stickers, if not more. And encryption is old enough, then keys should be free to use(Dolphin).

3:47 Ryujinx has guides for dumping your keys and firmware, and they have supporters on Patreon. Yuzu was the same. Why did Ryujinx not get sued by now?

I don't get the issue with monetisation in the discussion of emulation legality. The court cases commonly cited in defense of emulation, e.g. Sony vs. Connectix and Sony vs. Bleem dealt with explicitly for-profit emulators — you literally had to purchase the software on disk. The Yuzu dev team made a lot of bad choices, especially around the ToTK leak and the sharing of product keys, but charging money for a legal product (assuming that Yuzu was legal) shouldn't be a problem. On the flip side, if Yuzu was indeed illegal because of copyright infringement, that would still be case if it was exclusively available for free (like the many fan games that have been taken down by Nintendo). It may very well be that the monetisation of the product influenced Nintendo's decision to go after Yuzu (and it is completely understandable that other devs have rushed to demonetise their emulators since the lawsuit), but that is another issue entirely and has little to do with the legal status of emulation as a whole in my view.

I don’t feel playing switch emulators. Besides it really sad yuzu shut down with Citra.

I don’t want suyu shut down neither it makes me sad about it.

I can still see Nintendo going after this as well, unfortunately, albeit with some tweaks to their argument. The Switch's sucess has put them in a money diving Scrooge McDuck situation and might be worth a punt for a few million to pursue it. I don't want them to get the precedence they are no doubt seeking, that would be disastrous for emulation and gaming preservation, but it wouldn't surprise me if they give it a shot.

So basically Suyu is doing what Ryujinx has been doing since the beginning. Why not support Ryujinx instead?
