In this video, I have discussed Asma Jilani case law which is very prominent in the constitutional history and development of Pakistan. A brief overview is as follows:

Background:
In 1969, General Yahya Khan took over Pakistan and scrapped the existing constitution. He dissolved the national and provincial assemblies and limited the power of the courts through the "Removal of Doubts Order 1969."

Facts of the Asma Jilani Case:
The Asma Jilani Case involved two writ petitions filed in 1971 against detentions under Martial Law regulations: one by Asma Jilani in the Punjab High Court and the other by Zareena Gohar in the Sindh High Court. Both petitions were dismissed due to the courts' restricted jurisdiction under the Removal of Doubts Order 1969.

Appeal in the Supreme Court:
Asma Jilani appealed to the Supreme Court, challenging the courts' jurisdiction and the validity of the Removal of Doubts Order 1969. The court also revisited the Dosso Case, which had upheld martial law under General Ayub Khan.

Decision of the Supreme Court:
The Supreme Court ruled that the judgment in the Dosso Case was invalid and that martial law under General Yahya Khan was unlawful. It declared all orders and regulations under this martial law illegal, along with the detentions. The court also rejected the limitation on the courts' jurisdiction.

Conclusion:
The Supreme Court deemed both martial laws imposed by Generals Ayub Khan and Yahya Khan illegal. It directed the President to establish a new constitution and reinstate democracy in Pakistan.
