Disgree with this observer's opinion. The three determinations to be made are; 1. Did the person previously take an oath to the Constitution?, 2. Was there an insurrection?, and 3. Did the person engage in or provide aid and comfort to the insurrection? Section 3 is not a criminal statutue. It is a proscribing or prohibiting provision. It prohibits the conduct and prescribes a consequence. That consequence is disqualification from holding a public office or military position.
