As long as there is corruption with the authorities in different departments including in Courts, people cannot expect justice. Mostly our Judicial and Police system are criminal-friendly. The more you have money, there is more chances of justice in your favour.

Absolutely, explained in details by the Advocate of Supreme Court. It is irrelevent to say that present laws i.e. IPC, CRPC are not colonial law due to amendement it by the time and various judgement. Hence, the new laws should be explain in.details. Everybody knows that India“s pilice modus operandi.

Is there a chance that there would be a review of the shortcomings of the new codes? There would be anarchy and only escalation of load on the courts all over. I really feel there should be deferment of the date of implementation.

The laws seem to have made for harrasment of common people and opponents of the rulling party and are massively impractical. The discussion is very helpful. Please provide similar interpretation for the other two laws.

Very useful info.. For the issues that Mr Nipun pointed out in the some of the changes new law - can he tell whether govt gave the motivation or justification behind those changes?

Do you think all the judges in the country have read new law, understood it and ready to take action? Or like GST there will be trial and error for years to come.

CrPC is not colonial. As it was enacted in 1973. Almost 30 years post independence

What is the difficulty in amending “ unfair” provisions based on experiences once in 6 months till stabilisation? All misuses can not be envisaged in advance? Any policy can be questioned.

Please see 4:50 onwards.

Please tell your distinguished legal luminary that no state amendments are in limbo as they have all been repealed.
Secondly, atleast I and people of my skill, experience and understanding know it very clearly that all the previous state amendments have also gone away with the repeal of the old laws to which they were all added.

Since the gentleman says clearly that he doesn't know whether the state amendments would be operative or not...please tell him that that they would not be.

I hope you will really bring some good, senior and experienced lawyers who have put in at least three decades or more in specialised practice rather than the phoney introduction that Mr. X is an advocate in the Supreme Court. There are some advocates in the Supreme Court who are much poorer performers than the advocates in the Civil Courts.

Well, the SHO has greater degree of Responsibility, and Accountability as to WHY HE HAS NOT TAKEN UP criminal investigation or FILE an FIR, as needed. He could be susoended or even, DISMISSED for misconduct

In a nutshell, Bhadrajee, the laws would come down heavily on criminality, in whichever form, or modus, while, simultaneously, seeking to fast-track criminal investigations
Most importantly, THE PUNISHMENT WOULD NEED TO COMMENSURATE wilh the CRIME, and BAIL, now becomes on Case to case basis, and not a matter of RIGHT, or PRIVILEGE, especially in rural India

The new 'Bharatiya' laws are not only idiotic, but also pernicious!!
I've been saying this ever since these 'laws' were 'passed'...!
These new laws are 70-80% copy-paste from the old laws without any substantial changes (this even many lawyers have averred!)
One can logically argue that if there is so much overlap between the old & new ones, then what the heck is the need to bring in the new laws, which, by themselves, would lead to a ton - a TON! - of logistical & practical issues!?!?!
As is usual with this govt., this is an absolutely idiotic, un-thought-out move; doing things just to do something!); but/and wherever the laws actually have been changed, most of the changes (not all, but most) have been made to make the laws much more stringent; giving too much power in the hands of police/DM/govts! This would, obviously, lead to even more police corruption - bribery, police brutality, etc.!
Human & individual rights have been relegated to a distant second place!
This is very dangerous & will lead to a police state, and more harassment of citizens; more stifling of freedom of speech/expression & more unnecessary/frivolous cases, thus, further clogging the Indian judicial system!
In short, the new laws are asinine & pernicious both in concept, policy & practice!
Just like Agnipath/Agniveer scheme was the most idiotic & pernicious thing to occur to the Indian military & national security, so are these laws for Indian legal system, judiciary, and individual rights & freedoms...!!
Yet another classic example of BJP's ineptness of framing laws/policy...Beyond a certain point, ineptness can't be distinguished from malice...and I am beyond being charitable now, and I genuinely think this was done deliberately by BJP in order to make India a more police state...in order to retain power, and try to rule in perpetuity...
And, the Judiciary has let the people down with their indifference & pusillanimity...!
