Trump speaks before historic criminal trial over 'hush money'

Donald Trump was seen arriving in court on Monday in his criminal trial involving the adult film actor Stormy Daniels and the former Playboy model Karen McDougal. Trump, the first former US president to face a criminal trial, is accused of paying Daniels and McDougal to cover up alleged extramarital liaisons that could have damaged his candidacy in the 2016 election. The trial is scheduled to start this morning, with jury selection in Manhattan supreme court.

If the lawyers representing a hospital meet with the lawyers representing a patient who was injured by malpractice, and agree to pay X dollars to the patient, in exchange for the patient and his family NOT pursuing legal action agasinst the hospital, that is called a "negotiated settlement" and is legal.

If an individual agrees to pay X dollars to another individual who he was alleged to have done some harm to, in exchange for that person agreeing NOT to pursue legal action against him, that is called "hush money", and apparently it's illegal...sometimes?

They're ultimately the same thing., Why is one legal, and the other, not?
