If she spent money on a lawyer and time on finding a way to trespass onto the neighbor's property, can't she use her resources to REMOVE the small tree and create an entrance that doesn't encroach onto the neighbor's property??

She lost my sympathy the second she said "they had lawyers involved"! You can't sue to get something that is not yours.

So this woman is upset that she no longer has access to someone elses property to gain access to her property? Why is it the new homeowners responsibility to accommodate the neighbor?

Had a similar issue when we bought our first house. Older couple next door had always gone through our property to take their trash cans to the alley. They didn’t have alley access but the city verified their trash could be picked up from in front of their house. We got a permit and fenced in our back yard blocking their alley access through our property. We quickly realized they were great neighbors and found a solution that worked for everyone.
I ended up putting in a gate to their yard and we took their trash cans out to the alley and back every week for 16 years. When they past away, I sealed up the gate.

The lady is wrong. The neighbors did everything legally. I had to build a fence because of my neighbor. Our backyards meet. She has less than 25ft of yard. I have 80ft of backyard. She is a woman who likes lawn ornaments. Big ones. Near the house, I have shade trees and the rest is just grass and sunny. She was taking up my backyard with her ornaments and a table and chairs! Not to mention, I look at the back of her garage. It would be a problem if she wouldn't pile junk behind it and overflows into my yard. I talked to her blue in the face and she claimed I was mean. So, I had the property lines checked, let her know about it and then I decided to move her junk and trash off my property and had the workers dump it all back in her yard. The I put up a 7' privacy fence. I was telling her what I was going to do the entire time. She came home and called the police on me. When they talked to me, they started rolling their eyes and said they understood. She sent threatening letters from lawyers. I took her to court with my evidence, the judge told her she was wrong and I could swear out a restraining order on her. That kept her quiet for a couple of years until she moved. All that trouble because I wouldn't allow her to use MY yard for her things.

She had an agreement to use the neighbours property as an access point and then made a gate into the other property however once the neighbour sold the property the agreement expired and the new owners are not obligated to allow her continued access.

Unfortunate for her but nothing she can do about it.

She owns the duplex since 1999, and knew they were getting older.
They could have rectified this backyard issues years ago.
But users and takers always want more and hate when it's taken back.

The neighbor is just covering themselves for liability issues, shared access when the husband is ill.
If he falls and hurts himself on their walkway this couple could sue them.
And with that little of a backyard I want some privacy too!

20+ years ago, an elderly woman using a walker strayed onto a neighbor's driveway, tripped, fell flat on her face. Who do you think she sued AND WON AGAINST? The homeowner. So, if the neighbor does not intend to maintain that walkway (which is apparently in THEIR property) or if they are concerned about someone (like a disabled elderly neighbor) using the walkway, falling or getting injured somehow, and suing them, then they may want to block it off. Do you think if this woman's husband fell on this walkway that they would hesitate to sue the neighbor because it's on their property?

She just needs to get rid of that tree at the side of her house and swap that bit of railing for a gate and job done. What's the problem?

After listening to the woman, I understand why they put the fence up. I would not want to deal with her either.

so she was using someone elses property to access her backyard...so fix your fence, cut down that tree, pay to install a gate and bam, problem solved. whats the big fuckin deal?

Why doesn't she just use the money she spent on attorneys to build her own entrance/access on her property. It would be nice to let her use it, but if they don't want to, they don't have to. Maybe the new neighbors feel like it is an insurance concern, maybe they are very private, maybe they have disabilities of their own. Just build your own access on your own property and problem solved.

If anyone defends this woman, just remember, if she or her husband get hurt on the neighbors property, they would have the legal right to sue. So good for putting up a fence

Omg I have the same problem with my lovely neighbor she had an agreement with the old home owners to have her fence up to my property.!!! Mmm yea no not happening new owners not ok. People need to understand that when a home is sold you can’t expect the new owners to keep the agreement with the new owners.

why the hell should any neighbour feel they have the right to use others property, I'm sure if there had been good neighbours to each other there wouldn't be this issue, the fence is legal.

Unfortunately the fence owner has to do this or else after a few years he could lose that land because he didn't stop them from making it theirs.
