Donald Trump sues E. Jean Carroll for defamation

Donald Trump has sued E. Jean Carroll for defamation after a jury found he sexually abused the former magazine columnist and defamed her. In a counter claim, Trump alleges that Carroll defamed him when she appeared on CNN the morning after the jury awarded her $5 million in damages. Carroll was asked about the verdict finding Trump sexually abused Carroll but did not rape her as she alleged. Carroll said, “Oh, yes he did.”

Was the police notified when the alledge rape happened? Was their any physical evidence, DNA, fingerprints, camera footage, anything? Did she screamed for help, and someone responded? Where did the rape occur, and at what time of day? I bet if you get the answers to these questions, you have to conclude that her testimony doesn't add up, but then again, we're talking a New York jury, go figure.

By definition, defamation is any false information that harms the reputation of a person, business, or organization. Defamation includes both libel and slander.

Libel is written, while slander is verbal.

From Trump's countersuit and Ms. Carroll's CNN appearance following a jury finding Trump liable for sexual abuse, one might surmise that Trump claims Ms. Carroll's statement as slander, and that his "proof" is the verdict itself.

Trump, always the strategic genius (and a very stable one, at that), in countersuing Ms. Carroll, has just set himself up for a religitation of the entire claim of rape...at his behest.

But things will never get that far. For, in order to prove defamation beyond a preponderance of the evidence, Trump would have to prove a negative while simultaneously confessing to lesser offensive conduct; that for which the jury in Ms. Carroll's defamation case already found him liable. In so doing, Trump would also have to confess knowing Ms. Carroll. A claim he's made continuously.

Beyond all of this, Trump's countersuit is, in itself, defamation. So, when Trump agrees to settle the current defamation case against him, the monetary damages just increased exponentially.
