Transfer Of Immovable Property by Co owner
When a Property is Own by two or more persons , and anyone of them want to transfer his share in the property can transfer his share , But following conditions must be considers to the validity of the transaction

When a co owner is going to transfer his share in the immovble property then he can only transfer such part of the property which is certin and specified to be his share

When the property belongs to undivided family or joint family ; and the property is transfer to a person who does not belong to the co owners family in such case keeping in view the public policy the transfer will not be a valid transfer .

NOte , The transferee will have to accepts the burdens of the property
The transferee is bound to buy only the property or share which belongs to
the transferee .

Section 45 of TOPA
Joint Transfer For Considration

subject to the contract to contrary or keeping in view there share in the property they will get equal interest from the transfer

Section 46
Transfer for consideration by persons having distinct interests.
subject to the contract to contrary , the will get share according to there investment .
