In the beginning, when there is no congestion, shouldn't the ECN be set to 01 or 10 to indicate that the source/destination has ECN capable transport. Then when one of the routers encounter a congestion, it will set the ECN flag to 11 indicating congestion which will be acked by the destination tcp to the sender tcp by settint the ECE flag to 1.
