RAW: Officer explains why man who is deaf was arrested following traffic stop

A civil rights lawsuit was filed last week on behalf of Brady Mistic, who was arrested after a traffic stop in September 2019.

According to the lawsuit, Mistic cannot read lips and can only vocalize a few words. When he tried to communicate with officers using sign language, the lawsuit says they put him in handcuffs.

The lawsuit names Officer Nicholas Hanning and Officer Ellie Summers, who were both involved in the arrest. It also names the City of Idaho Springs, and the Clear Creek County Board of Commissioners.

The lawsuit claims Hanning was unnecessarily forceful, and the two officers used a stun gun on Mistic twice.

The lawsuit also says Hanning broke his own ankle during the arrest. Mistic was charged with second-degree assault on a police officer and resisting arrest, charges that were later dismissed.

when I spoke to cop friends and acquaintances before my retirement, I heard time and again that cops are supposed to expect the unusual in their chosen career, and since this 'officer' is clearly not capable of that she has become a danger to herself, her colleagues and her community.

I can't accept the cops answer. Both cops were abusive as they exited the car. Hope they both get the Karma that's heading for them. Would like to know the end result of this.

fire both cops, they lack training and the ability to diagnose a situation. We needed Andy Taylor to handle this situation. For the police to drop all charges tells me a lot.

Back when I took drivers Ed, we were taught to meet officers at the back of your car when pulled over. Then came the seatbelt laws and tickets couldn’t be given for failure to wear seatbelts if you met them at the back of your car. Then young police officers were trained different to throw other charges if you got out of your car. That is the history of the evolution that created stories like this.

He did not approach the car. The car pulled up to him.
