In case anybody is curious, having done some reading around it would appear that the PS3 HDMI output is protected, and the only real way to get around that to capture footage using the Elgato is to use RCA output instead, so sacrificing a bit of quality. Next time I want to do some PS3 gameplay I will try this as I do have a RCA to HDMI upscaler which you would also need.

Have you seen the ps3 blowout trick, to self clean 😊, so to turbo the fan, to blow the dust out, if any 👍 saves opening it up if yours isn’t too bad
