A plea was filed by the CBI against two recent orders passed by the Special CBI judge.
๐๐ก๐ ๐๐๐ฅ๐ก๐ข ๐๐ข๐ ๐ก ๐๐จ๐ฎ๐ซ๐ญ ๐ก๐๐ฌ ๐ช๐ฎ๐๐ฌ๐ก๐๐ ๐๐ง ๐จ๐ซ๐๐๐ซ ๐จ๐ ๐ S๐ฉ๐๐๐ข๐๐ฅ ๐๐๐ ๐๐จ๐ฎ๐ซ๐ญ :
Justice Chandra Dhari Singh said it was โoutrightยญly illegalโ for the Special CBI Judge to issue show-ยญcause notice to the CBI Diยญrector to explain why not a reference of contempt of court be made against the CBI officers for the purportยญed nonยญcompliance of its orders.
โUnder Section 15 of the said (Contempt of Courts) Act, only the Supreme Court and the High Courts have the power to suo motu take cognisance of the alยญleged contemptuous acts,โ Justice Singh said.
The Special CBI Judgeโs order was against the proยญcedure laid down under the Contempt of Courts Act as also under the rules framed by the High Court as regards the contempt proceedings, Justice Singh added.
