I have inherited my mother's property (flat) in 2016/17 which was purchased in 1960. I cannot remember the price she paid for it as I was an infant then. I am in negotiation with the current tenants living there since 50 years to buy over the property. The Property is in Mumbai. They have offered me half of the market price as they refuse to move out. The price offered is about 2 Crore. How would I handle this TDS issue and do you handle the TAX issues for NRI property in Mumbai ?

I have understood the video if I bought the property for 50 lakhs in 2009 and selling it for 75 lakhs in 2023, If I apply for LTDS. How much money I will receive from buyer. I have to take 15 lakhs as first part. After submitting LTDs buyer bank will deposit 55 lakhs. 5 lakhs buyer will deposit in income tax, I can file ITR and then claim the amount of 5 lakh. Is it correct ? Generally how much is LTDS tax percentage.

With An Aadhar card and Pan card with local address, Sell the property as a RNOR status. RNOR is a transient between NRI and Resident status. FEMA has no set timeline to convert NRO/NRE accounts to resident accounts for RNOR status Only 1 % TDS. Key is to pay the Capital gains immediately, after sale. That satisfies the Tax authorities, whose main concern is Tax evasion and tax collection. Otherwise the lengthy LTDS process of Form 13 (45 days) is tedious. Getting money back from I Tax (2 years)is even more cumbersome, may involve practices which India is famous for.

What if property is jointly owned. Does the NRE / NRO account need to be joint or do we have to split equally and pay both their accounts?

Capital gain tax is very very high in India now.. That tax pulls down sale and thus decreases Central tax income + livelihood of deed writers, clerks etc ( who depend upon deed servicing for livelihood) and decreases State Registration income. So it is a Total Mess taxation. This Tax helps no body, neither the seller nor Central or State Govts. Short term gains should be taxed at maximum 8% and long term at 5%>>. Then more sales will occur and thus more gains for Central and State Govts. And more smiles on the face of Deed writers etc.

I don't understand how TDS of 30% on STCG is profitable to the NRI doing real estate.
For example as an NRI,
a) I bought a plot for 10 lakh
b) In 4 months, I constructed a house on that plot for 15 lakh. My total expenditure is 25 lakh
c) Now my selling price is 35 lakh.
According to the above scenario it is a short term capital gain.
And a TDS of 30% on 35 lakh would be 10 lakh and 50 thousand. I spend 25 lakh and I get 24.5 lakh.
How is this profitable to me?
Or am I missing something?

has bought land and the person selling this land has come from abroad. And this ID proof is from Punjab and while preparing the registry papers, the address outside that has also been written and this file has been given to the Naib Tehsildar after preparing all the registry papers. There will be no problem of NRI address in this, as it is said that NRI's TDS is cut. Please clarify sir.

under which section tds will get deposited for token money and for final settlement? if there are two seller for 85L then they are going to counted for less than 50L. correct ?

If the NRI lives in india for more than 180 days, how much TDS should be deducted?

I have one question, My current flat price is lower than 50lac so I was not deducting TDS from instalment payment to builder, I requested for ownership transfer to another buyer before flat registrars so new buyer paying me flat cost higher than 50lac but since its ownership transfer so actual cost of flat is still below 50lac, can help to confirm do we need to pay TDS in this case ?

Sir, On approved lower TDS rate, do we need to add surcharge and cess ? For example approved lower TDS is 4%, and sales value of more than 1Cr, then do we need to add 15% surcharge and 4% health & education cess, so total tds rate will be 4.784% ?
