Divorced Muslim Woman Can Seek Maintenance: Supreme Court | SC Rules CrPC Sections Also Applicable

The Supreme Court on Wednesday said that a Muslim woman is entitled to maintenance from her husband under Section 125 of the Code of Criminal Procedure (CrPc). The bench comprising Justices BV Nagarathna and Augustine George Masih dismissed a petition in the case, in which the man filed a plea against the direction to pay interim maintenance to his divorced wife under Section 125 CrPC.

Its not a landmark judgement, law is already exist under CrPC 125, in this Supreme Court judgement Court only explain 125 nothing more, kam se kam Kanoon ko samajh to liya karo pahle news Banane Se Pahle

Now a days, even a lady can be charged with rape if the boy is minor, though theoretically boy/man cant be raped by a girl or woman

So, divorced wife getting alimony is FAIR

There is one more aspect that's not touched upon, but very important

Can a Muslim MAN claim alimony from his WIFE in a religeous divorce, that is real gender neutrality

Religion apart, this ensures that helpless woman are not dumped with some meagre amount mentioned in marriage deed

What if the amount mentioned in the marriage deed is Rs.50, 000 or one lakh

Young people are not marrying... with the expanded horizon of part of the judgement to non earning wives in a functioning marriage...will prevent marriages further and live in relationships will be the norm. Unsure whether that is good for children born in such relationships.
