You can get added protection with contract for deed if you see a lawyer. Then you have added layer of protection. My auntie bought her house in 88 through contract for deed. She had great work history but no credit. The realtor specifically showed her For Sale By Owner properties where they could work a deal with her. She saw a lawyer and both parties agreed to the terms. They typically don't last long, around 10 years. She paid that house off and later gave it to her son.

I just learned that "Subject To" is not possible in Canada 🇨🇦, however "Agreement For Sale" is possible! I'm looking forward to learning how to do this! One possible drawback I'm thinking is that most mortgages in Canada are locked in for 5 years (or even variable rate), so I'm not sure how that would work if the owner needs to refinance the mortgage once the 5 year term is over.

What happens when the underlying mortgage is not paid, property taxes aren’t paid, insurance is not paid? I assume all of those would be a default in the wraparound agreement and then what happens?

@pacemorby is there a step by step guide to understand what needs to be done? What paperwork goes into this, how does it work if you are talking to the realtor not the owner? Is it still possible? Do you have a book I can read or a set of podcasts that goes over in great detail each step? I am absolutely FASCINATED by your content

But let’s say u have a 5 year option in place with the contact for deed can I refinance the property by myself and cash out the owner for our original purchase price?

so when you submit the documents to the county records to record a lien on the property as security, what exactly are you putting as a lien? If you need time to find your CB in the novation agreement?

I have an agreement for deed i’m looking to sell. I still owe $10k but the deed to the home has transferred twice since i’ve owned it. What options do i have? Am i even still
N contract, i don’t think this was ever recorded

So the deed is in the seller's name, and we defaulted on the 2-3 payments. Now they want to sell the property, will they require our permission to do so?
