US says Israeli shot ‘likely responsible’ for death of Abu Akleh

The US State Department has said that independent investigators could “not reach a definitive conclusion” regarding the origin of the bullet that killed Al Jazeera journalist Shireen Abu Akleh, but said Israeli military gunfire was “likely responsible” for her death.

“Ballistic experts determined the bullet was badly damaged, which prevented a clear conclusion,” according to a statement on Monday.

The US Security Coordinator, by summarising investigations by both Israel and the Palestinian Authority, also said on Monday that the detailed forensic analysis showed no reason to believe that the shooting was intentional.

Abu Akleh was shot in the head on May 11 while covering an Israeli army raid on the Jenin refugee camp in the occupied West Bank, despite wearing a flak jacket and helmet clearly marked “PRESS”.

Palestinian officials, international rights groups and media outlets, carried out independent investigations that concluded that Abu Akleh was killed by the Israeli military.

I have heard Israel claim that errant rockets or mortar fire from the Palestinians caused these and other deaths, or that the attacked spots were being used as arms depots or launching sites. Speaking of Jewish power is something that only American Jews are allowed to do in celebration (see Alan Dershowitz– “We are entitled to use our power. We have contributed disproportionately to the success of this country.” Or Bari Weiss praising “Jewish power… Jewish success”). But as soon as this influence gets called out – that’s a conspiracy theory or reprise of the Protocols of the Elders of Zion.

Let us remind you of a few events that bear out that power.

Jimmy Carter was a one-term president in part because he took on the Israel lobby over settlements. Stuart Eizenstat, Carter’s liaison to the Jewish community and later Hillary Clinton’s, wrote recently that Carter ascribed his loss to the opposition of “New York Jews” who had formerly supported him but were alarmed by his criticisms of Israel’s settlements. Eizenstat frankly described the political clout of the Jewish community:

It is even clearer in the decades since, that progress on these same intractable issues with which Carter was struggling forty years ago can come only with a president willing to take enormous domestic political heat and plow ahead. None have done so since with the same combination of his grit and determination—indeed, perhaps because of the political wounds he suffered.

Even Tom Friedman has ascribed George H.W. Bush’s loss in 1992 in part to his hard line on the settlements. “Republicans post Bush I, and manifested most in his son Bush 2, took a strategic decision, they will never be out pro-Israel’d again. That they believe cost them electorally a lot.”

Indeed, in 1992, Bill Clinton won the presidency and ran to Bush’s right on Israel issues, and gained the blessings of the lead Israel lobby organization AIPAC.

AIPAC had unfettered access to the White House under Barack Obama, too. Obama’s top foreign policy aide, Ben Rhodes, has said that he spent more time dealing with 10 to 20 Jewish groups than anyone else, and those groups were piping the Israeli government line. “It’s not a conspiracy, it is what it is.”

The number of people youmeet from the organized pro-Israel community equals all the other meetings that you might do with kind of diaspora or constituency groups on all the other issues. It’s that degree of dwarfing. Over the eight years I met so many times with like the usual suspects from the organized American Jewish community… it’s kind of like 10 to 20 people that you find yourself meeting with all the time… It’s not a conspiracy, it is what it is. People are advocating a position. But it’s a common position. Whatever the tension point between us and the Israeli government was at a given time, they were usually coming in to represent what I knew to be the Israeli government’s view in that circumstance….Whenever there was an international incident like the Goldstone Report or the Turkish Flotilla, you have to make sure that you’re doing everything that you can at the U.N. to kind of block this from going forward.

We know how this power arose. The Jewish community has exhibited a remarkable unity in support for Israel since the 1967 and 1973 wars, at times a lockstep, and it has sought to punish dissenters. Even liberal Zionists like the group Breira, or the writer Leonard Fein, were crushed when they dared to cross Israel.

"FIRST WE WERE ASHAMED, then we were shocked, and we even investigated. Then we denied it and lied. After that we ignored and repressed it, yawned and lost interest. Now is the worst phase of all: We’ve started to extol the killers of children. That’s how far we’ve gone.

The first child I remember wasn’t even a day old. His mother, Faiza Abu Dahuk, gave birth to him at a checkpoint. She was turned away by the soldiers from there and from two more checkpoints, until she had to carry him, all through a cold and rainy night. When she arrived at the hospital, he was already dead.

The matter came up at a cabinet meeting. An officer was dismissed and a mini storm ensued. This was in April 1996, during the year of hope and illusions. Four years later, when the second intifada broke out, soldiers killed Mohammed al-Dura in front of the cameras and Israel had already transitioned to the phase of denials and lies: Dura didn’t die. Israeli soldiers didn’t kill him; maybe he shot himself, maybe he’s alive to this day.

Remnants of shame and guilt still clung somehow. After that came 20 years of indifference and complacence. Soldiers and pilots have killed 2, 171 children and teenagers, and not one of these cases shocked anyone here, or sparked a real investigation or led to a trial. More than 2, 000 children in 20 years—100 children, three classrooms a year. And all of them, down to the last, were found guilty of their own death.

Any Israeli would be happy to explain that they were terrorists and the soldiers, or the police had no choice but to execute them. In the alternative between the lives of the children and the sacred lives of the soldiers, of course we prefer the soldiers, although there’s almost always a third possibility: for no one to be killed.

Last week the next phase was declared. Israel praises the killers of children; they are the new heroes."

"The only way to make sense of Israel's senseless war in Gaza is through understanding the historical context. Establishing the state of Israel in May 1948 involved a monumental injustice to the Palestinians. British officials bitterly resented American partisanship on behalf of the infant state. On 2 June 1948, Sir John Troutbeck wrote to the foreign secretary, Ernest Bevin, that the Americans were responsible for the creation of a gangster state headed by "an utterly unscrupulous set of leaders". I used to think that this judgment was too harsh but Israel's vicious assault on the people of Gaza, and the Bush administration's complicity in this assault, have reopened the question.
I write as someone who served loyally in the Israeli army in the mid-1960s and who has never questioned the legitimacy of the state of Israel within its pre-1967 borders. What I utterly reject is the Zionist colonial project beyond the Green Line. The Israeli occupation of the West Bank and the Gaza Strip in the aftermath of the June 1967 war had very little to do with security and everything to do with territorial expansionism. The aim was to establish Greater Israel through permanent political, economic and military control over the Palestinian territories. And the result has been one of the most prolonged and brutal military occupations of modern times.

Four decades of Israeli control did incalculable damage to the economy of the Gaza Strip. With a large population of 1948 refugees crammed into a tiny strip of land, with no infrastructure or natural resources, Gaza's prospects were never bright. Gaza, however, is not simply a case of economic under-development but a uniquely cruel case of deliberate de-development. To use the Biblical phrase, Israel turned the people of Gaza into the hewers of wood and the drawers of water, into a source of cheap labour and a captive market for Israeli goods. The development of local industry was actively impeded so as to make it impossible for the Palestinians to end their subordination to Israel and to establish the economic underpinnings essential for real political independence.

Gaza is a classic case of colonial exploitation in the post-colonial era. Jewish settlements in occupied territories are immoral, illegal and an insurmountable obstacle to peace. They are at once the instrument of exploitation and the symbol of the hated occupation. In Gaza, the Jewish settlers numbered only 8, 000 in 2005 compared with 1.4 million local residents. Yet the settlers controlled 25% of the territory, 40% of the arable land and the lion's share of the scarce water resources. Cheek by jowl with these foreign intruders, the majority of the local population lived in abject poverty and unimaginable misery. Eighty per cent of them still subsist on less than $2 a day. The living conditions in the strip remain an affront to civilised values, a powerful precipitant to resistance and a fertile breeding ground for political extremism."

Legal experts on apartheid and Israel: ‘Occupation, Colonialism, Apartheid’
In 2009, an international team of legal scholars working under the auspices of the Human Sciences Research Council in Cape Town, South Africa published a study called 'Occupation, Colonialism, Apartheid?' The study concluded that the Israeli state has imposed a state of apartheid on the Palestinian people, in that Israel is guilty of many of the practices and policies identified in the Apartheid Convention adopted by the United Nations in 1973, and that these acts together constitute the “integrated and complementary elements of an institutionalised and oppressive system of Israeli domination and oppression over Palestinians as a group; that is, a system of apartheid.”
The study noted that Israel has implemented all three of the pillars that characterised apartheid in the South African context, namely: (a) the categorisation of the population along racial lines; (b) the segregation of the population on the basis of this categorisation into different geographical areas allocated to different racial groups; and (c) a system of laws and policies that subject the Palestinian people to extrajudicial killing, torture and arbitrary arrest and detention, as well as sweeping restrictions on Palestinians’ rights to freedom of opinion, expression, assembly, association and movement.
In 2020, Israeli human rights organisation Yesh Din published a legal opinion that concluded Israel’s regime in the West Bank is apartheid: “The crime of apartheid is being committed in the West Bank because, in this context of a regime of domination and oppression of one national group by another, the Israeli authorities implement policies and practices that constitute inhuman acts as the term is defined in international law”.

Human rights organisations are increasingly using the term ‘apartheid’ to describe Israel’s regime. For example:

In 2020, over 450 civil society groups across the world, including War on Want, launched a campaign calling on the UN to investigate “Israel’s apartheid regime over the Palestinian people as a whole” and to take “urgent and effective action” to end Israeli apartheid.

In 2021, Israeli human rights organisation B’tselem wrote a report examining Israel’s policies in the entire area under its control, concluding that: “The Israeli regime enacts in all the territory it controls (Israeli sovereign territory, East Jerusalem, the West Bank, and the Gaza Strip) an apartheid regime.”

In 2021, a report by international human rights organisation Human Rights Watch concluded that the crimes committed by Israeli authorities amount to apartheid: “Human Rights Watch found that the Israeli government has pursued an intent to maintain the domination of Jewish Israelis over Palestinians throughout the territory it controls. In the OPT, including East Jerusalem, that intent has been coupled with systematic oppression of Palestinians and inhumane acts committed against them. When these three elements occur together, they amount to the crime of apartheid.”
