Substantive due process is only a made up concept to someone when it’s an inconvenience to them. Before 1937, substantive due process was used to protect many of the economic liberties that we still have today. Look at Lochner v. New York. People get due process and due process of the law confused. The law being the Constitution. If an action is not in accordance with the law of the land, then it is unconstitutional. That is why our fundamental rights are so important because the framers wanted to protect these rights from state and local interference. Unless, strict scrutiny is met of course. Also, it is not just the 5th and 14th amendment, the 9th amendment is also very important when discussing our fundamental rights when not expressly mentioned in the Constitution. This gives the Court the right to safeguard unenumerated liberties such as the fundamental right to marriage, travel, voting, court access, sexual activity and orientation, medical care decision making, etc.

Substantive Due Process has always been a dubious legal theory. The idea that the state can't take away your right to an abortion, but somehow can take away your freedom and your life is impossible to reconcile.
