Deshaun Watson Lawsuits Explained

On March 16, a massage therapist represented by Houston lawyer Tony Buzbee filed a lawsuit against Deshaun Watson, the star quarterback for the Houston Texans football team. The therapist alleges that Watson contacted her on Instagram to schedule a massage with her, and then assaulted her during his appointment.

Buzbee announced the lawsuit on Instagram in a post in which he wrote, “This case we just filed against Watson isn’t about money—it’s about dignity and stopping behavior that should be stopped, NOW!”

Watson has denied any wrongdoing and said that before filing the lawsuit, Buzbee sent him a “six-figure settlement demand,” which he rejected. “Unlike him (Buzbee)," Watson added, "this isn’t about money for me - it’s about clearing my name, and I look forward to doing that.”

To date, Buzbee has filed sixteen separate lawsuits against Watson on behalf of massage therapists who allege that Watson assaulted them.

In this video, I'll explain how the law in Texas defines assault and what the plaintiffs will have to prove to prevail in their case. We'll also talk about the different burdens of proof that apply in civil and criminal cases.

Lots of great points here, but there is an important one that was not made. You rightly explain that the standard of proof in a civil case is a preponderance of the evidence vs the criminal beyond a reasonable doubt. However, the standard used by a criminal grand jury is essentially the civil standard. More significantly, in a grand jury proceeding, only the prosecutor makes a case for indictment. There is no defense attorney involved to rebut any of the evidence. So, here, the prosecutor selected the strongest cases to pursue, made the best arguments they could make totally unopposed and still could not convince the grand jury that any of these cases contained enough evidence to meet the low civil standard. In my view, the inability to indict means that there is not a good chance of winning in the civil cases either. However, these cases will not go trial but will settle. Kind of a shame because defense verdicts would vindicate Watson and open the possibility of libel/slander counterclaims.

But Buzbee doesn’t know the McNair family? Your wife knows the McNair granddaughter (looks like they’re friends) and you live 280 feet from the Texans’ owner, but you don’t know the McNair family?

All Athletes should NEVER deal with Female Doctors, Massage Therapists, and, Drivers, Lawyers, Trainers, Etc, Etc...and especially Groupies..for this exact reason...this is why I was so glad that Becky Hammond didn't become coach of the Spurs... She should have never been considered for that post because of gender, and the fact that there were so many GUYS that had been playing in the league that should be considered for that post..Don't offer her that post for being Female!! If Mr Watson is a serial assaulter of female massage therapists, then he should serve time and pay all those women for their suffering. Justice demands payment for suffering. my question is these women are independent right. I mean having Instagram as their form of contact is a show of being an independent contractor. So as an Independent Contractor, I wonder how did Deshaun force them to do anything. They are self employed and do not have to answer to a boss/manager or Deshaun. It wouldnt be anything for them to call the police and have great chance to get justice at the time of the alleged act.

Has anyone investigated women to see if any of them has performed sexual acts during a session before. I know this is why some women did not want to identify themselves. A few of them have been called out by out by other men who said they had consensual sexual encounters with these women to. Do we know how many of these women are actual licensed therapists? Why are people acting like these women posing as therapists on Instagram does not exist!

This is really wild! I don't want to make any judgements before everything is on the table but there's all sorts of oddities that make this really hard to sort. Tony seems really sketch, the way the suits are being brought is strange and the sheer quantity and suddenness of the cases mixed with the D4 v Texans tale has people very unsure. On the other hand, one could infer a pattern of behavior from these accusations that leave D4 honestly putting himself in some really bad positions. Not an easy one to crack and the media seems relatively scared to touch it directly.
