The Equal Rights Amendment was passed by Congress in 1972. At that point, like all constitutional amendments, it needed to be ratified by three-fourths of the states, or 38 of them.

Since then, 38 state legislatures have ratified it, with Virginia’s becoming the 38th to do so in 2020.

There are two problems, though.

One is the deadline issue. Congress initially passed the amendment with a seven-year deadline for states to ratify it. Congress later extended that deadline by three years, to 1982, but the ERA still came up three states shy. The three additional states came much later.

The second is that, in the 1970s, five states voted to rescind their previous votes to ratify the amendment. In other words, only 35 states ratified it by the deadline, and only 33 states currently want it ratified.

This is nothing more than a pathetic, last-ditch effort to do something to earn a positive note in the history books before he goes down as the worst president of all time. Oh, and he didn't even do it! He's just declaring it!

This is not true, The Equal Rights Amendment is not a law of the land because it has not been ratified by at least 38 states . So there are only 27 amendment at the time Iam this as an attest to history this can researched

Except it's not...lol. I love how Joe leaves out the fact that in the 50 years the act has awaited ratification, 5 states have resended their original approval. The ERA currently sets at 33 states.

Sorry sir, it is NOT part of the constitution now. You need a convention of states to vote on changing the constitution.

I don't get it, if the 1st Section of Section 1 of the 14th Amendment ALREADY denies States the authority to deny "Equal Protection Under the Laws, " it does, WHY do we need another one?

That's EXACTLY what Loving v Virginia 1967 was based on.
They threw it out for 2 reasons.
Virginia had a Law that denied a WHITE person their right to marry a person of any other race, it ONLY applied to White people.
They rulled that if violated "Equal Protection Under the Laws, " and is supported racial discrimination.

That's the reason the 19th had to happen, it's because voting is State not Federal Jurisdiction care of the Constitution. Some, not all States were allowing women to vote.

Sorry Joe, but that train left the station decades ago. The ERA has been dead since the ratification deadline expired on March 22, 1979. You don't have the power to revive it.
