The EO reorganizing the NSC membership is not a law. The President has the exclusive prerogative to choose who the members will be. So whether the former presidents and VP are not included is no big deal. The next president could likewise direct a reorganization of the NSC members and has the option to include the former presidents and VP. So it all depends on the sitting president.
