The Colorado Supreme Court, comprised entirely of Democratic-appointed justices, ruled that former President Donald Trump cannot be on the ballot. Three of the 7 justices, including the chief justice, rejected the claim that Trump incited the riot and is thus disqualified under the 14th Amendment. Ian Samuel, a former law clerk for former Justice Antonin Scalia, joins “On Balance” to provide further insights.
