The provisional patent seems to be useless if Amazon does not take down knockoff listings. Why are you recommending it?

Just to clarify, Amazon does not take down knockoff listings based on provisional patents. Only granted design or utility patents.

A provisional patent is a place holder. It’s not a real patent. And a patent only gives you the right to sue someone else for infringement, where an average lawsuit cost’s $5million per case. So unless your product is doing $100 million in sales a year, it isn’t worth it.

How long should I wait for sales data before I put up money for a patent?

I dont think you get any protection during the provisional period. And it is VERY hard to get a patent granted.

hi camron. thx for the video. I have a question. my competitor took my listing down using her design patent. I created a new product with different design(I am sure my application will be accepted and published) and I am wondering if I start selling this new product and if my competitor reports my listing again, can my pending application protects me and reinstate my listing? if it doesnt then I have to wait until it publishs which is a very long period of time. thank you

This is inaccurate and misleading information, Amazon will not provide protection based on provisional patents, there's a reason he doesn't show the filing process with Amazon APEX
