Actually, some damage to 3rd party is still done. People shifting to other systems like OSR or OSE won't need the 5e items coming out. If it is system neutral perhaps.

I hate so say it but it doesn't remove the "they get your stuff for free" issue. They say you have to give permission. However they have not removed any verbiage where by signing this you give permission. So yes they have to ask. However by sighing they have asked you said ok, and I don't want payment and you can keep it forever.

Did you see what paizo said? Paizo has made an Open Rpg Gaming license. It’s under the protection of a law company and paizo not wotc owns it. You should check it out.
