I remember reading where the head of the HOA came round to a house where the garden wasnt being maintained. When they found out the op was struggling with an elderly parent (i think) the head had everyone come round and do the gardening and neighbours left ready cooked meals. Thats what a community should be. It was refreshing to read.

You would think that HOA’s in the USA would realise that ADA protects disabled people from discrimination from HOA boards and allows them to have changes made to their homes to allow easy access to and from the property not just for everyday usage but in case of an emergency where every second counts. Treating disabled access as a problem and a blight on property values is disgraceful.

No HOA rule or board decision can supersede any city, county, state or federal law. For example requiring a green lawn during a drought is a prime example of forcing residents to break the law.

Lawsuits can be both extremely expensive and stressful. I don't blame the people in the first story for not engaging in one, even though I would have loved to seen the HOA get shut down.

Even if the first OP went to court the HOA would be verbally backhanded so hard by the judge that when they came too they would be wondering how they ended up homeless.

If I was OP I'd still send a lawyer to have a letter sent to the HOA and make them change the bylaws to make this officially peaceful between us and the HOA.

Disability access story: HOA rules do not supersede federal law (or even state and local laws), which the ADA is. I do hope OP got the various proper building permits for his ramp, lift and other changes. Personally, I would have gathered up as many other residents on my side as I could and had a change of board members at the next HOA meeting.

should have taken the HOA to court for violating the ADA, instead of just covering the cost of renovations you could have won hundrededs of of thousands or even a million or 2. and probably had that A-hole removed from his position.

Interesting fact. Since July last year in Victoria, Australia (cannot recall if it's the whole country), It is a legal requirement that all newly built houses have access ramps and stepless showers.
Seriously though, having a disability friendly house would actually raise the value, if disabled or elderly people were looking to buy.
and I mean, we're all going to get old right? Makes sense to have a lot of those things installed.

the Americans with Disabilities Act (ADA) is absolute and no hoa rules will apply, meaning that if an hoa wants to try and violate the ADA, they will not survive the legal process and the massive fines that will be imposed

The third story, here in the U.S. it can get very expensive fast, for someone that's parking in a handicapped designated spot. Also don't let my daughter or I see it, one of us will certainly be quite happy to take three pictures with the "Parking Mobility" app we have, and send it to the state police. Who will be happy to send a ticket to the miscreant. Which the state it had happened on doesn't matter.
