Many of my clients tell me that the cops told them they don't have the right to an attorney when they're detained. If you are being detained, it is your absolute right not to answer questions until an attorney is present. To find out if you're being detained, simply ask, "Officer, am I free to go?" If they say no, you are being detained and invoke your Fifth Amendment right to remain silent.

A person doesn't actually have any rights if you can be detained for not doing anything wrong.

That question doesn't even come close to establishing whether the cop has reasonable articulable suspicion. It only answers whether the cop is willing to use force against you to force your compliance.

Record and ASK, “What crime do you suspect me of committing?” Get them to answer on camera.

I would say that about 95% (a little on the conservative side, I’ll admit) of cops will say, “We got a call about someone, matching your description, acting suspicious.”
Person: “Ok, what crime do you suspect me of committing?”
Cop: “We got a call about a suspicious person.”
Person: “What reasonable articulable suspicion, RAS, do you have that I committed, will commit, or are in the act of committing, a crime.”
Cop: “Suspicious behaviour is my reasonable suspicion.” <—- without a single ounce of irony awareness.

They just don’t comprehend (either through ignorance or mental illness) the full meaning of ‘Reasonable Articulable Suspicion that a crime has been committed’ and just leave off the ‘…that a crime…’ part.

You have the right to an attorney no matter what. Any officer that says you do not have that right is automatically in violation of the law. Do what he says and hash it out in court. Lawsuit and Make sure you remove his immunity so you can attach his personal property and pension.

In most states you are only required to give your ID if you have been lawfully arrested. If you are detained you don't have to show ID but you cannot give a false name.

Just ask “ if I don’t give you, my ID will be arrested?” if the cop says “yes” comply and give them your ID. Then file up with a complaint.. that’s the best way to bait cops into a lawsuit

you ask " am i free to go or am i detained?"
AND THE COP IGNORES YOU with no definitive ANSWER. now what? if you " stay" they say they have a consensual encounter. if you " leave" you tried to " flee" and therefore will be arrested. all of which will be in a state of " schrodinger's cat" a.k.a. you're BOTH being detained AND free to leave ; depending which one benefits the cops ability to steal your money via court.

Cops will “detain” you for anything including because you look suspicious so asking if you are detained does not always work.
