NRIs, Overseas Indians and a lot of Indian diaspora who lives abroad, this is for you guys. I want to finally put to rest a lot of rumours that are being generated in the west that all Indians who live abroad have to get Aadhaar cards made and they have to travel back and get these Identification cards made i.e. Aadhaar card. It is being said that It is vital must if you have properties in India. I want to put to rest all those rumours that are circulating outside and a lot of people that are calling to us whether this is true and what is the deadline they have. Let me start by saying that this is absolutely baseless. Aadhaar cards are only and only needed by resident Indian citizens. NRI’s, overseas Indians and people of Indian Origin who do not live in India or do not have an earning in India DO NOT NEED AN AADHAAR CARD at all for any purposes. So please, trash all that news. It is baseless completely and Aadhaar cards are not required by NRIs. Do not believe in people saying otherwise. If at all that changes through a notification by the government we would be the first to tell you through Blogs, websites etc. I thought I should do a video about Aadhaar card is not needed and you do not need to travel back to India for making it.

Another constant enquiry which we have dealt with is PAN Cards. PAN Cards I.e. Permanent Account Number is your number which is registered with Income Tax Department of India. There are a lot of questions about “Should NRIs have a PAN Card” or “How do you make one” etc. etc. My advice on PAN card is anybody irrespective of the fact that if he/she is a resident Indian needs a PAN if he/she has a property in India. You need to register with the Income tax department, you need to get your PAN Card done. PAN Cards can be applied online. Just type PAN-Open the Government website. There is a full-fledged module where you can apply and deposit the fee. They would send the PAN Cards to the country of your residence. You can do it yourself. You can do that through several agents too present here for those who are not familiar online. It is a fairly simple way to do it and you must have it if you have a property in India because you can neither sell or buy property without a PAN Card. It does not mean you need to file your taxes. Even if you do not have an income in India, you need to file it saying no income in India. So, you need to have a PAN Card if you have a property in India and any type of Bank account in India.

The OCI cards. There are so many people who do not understand OCI Card. OCI is basically Overseas citizen of India which in fact allows you to travel visa free to India. It is nothing but a recognition that you are in spite of your citizenship other than India, they recognise you and differentiates you from the foreigners. So, in spite of the fact that you are a UK Citizen or a US Citizen or an Australian citizen-you are treated differently than a foreigner. So OCI Card gives you unlimited access to travel to India, it gives you a recognition. A lot of time when you want to buy properties and you have foreign passports, the OCI Card helps you to buy properties. A lot of states are making this mandatory for people who live overseas to have an OCI Card. So OCI card does not affect your current citizenship at all. It does not offer you Indian Citizenship or dual citizenship. Just merely OCI Citizen means Overseas citizens of India and they recognise you as persons of Indian Origin. I would recommend anybody or everybody who needs to visit India often get an OCI Card.

Thanks a ton, Nidhi, for these very important information, which I found to be very clear an to the point... being an NRI (UK) I was a bit confused to whether I needed an Aadhaar card or not... glad I don't need one - a big relief. !!! Thanks again....

I had mentioned earlier that while I was in India I was told by a lawyer and THEN by the AADHAR card officer himself that I WILL need an aadhar card and had challenged you when you had said that that is not the case. However after consulting with more lawyers and the senior official who sits in the Aadhar card branch of Pragati Maidan, New Delhi I have the final information. YOU are ABSOLUTELY correct and I was wrong. Not ONLY aadhar card is not needed for OCI but actually CANNOT be made for OCI holders UNLESS they can PROVE that they have been residents of India for more than 180 days. The practical chances of THAT happening are actually zero for most OCIs. So you CANNOT get aadhar card in general for an OCI. The property transfer, as you said does NOT need any Aadhar card.

Just an update I am Canadian citizen (OCI holder) and got married here in India and to register my marriage in Indian court I needed a Adhaar card. That’s what the lawyer said and is required. They don’t accept OCI card as a address proof. I talked to few advocates and all they asked me for my Adhaar card and my Matriculation certificate. They said passport is not enough for age verification. This happens at Mohali court and Chandigarh sector 17 courts.

I am having my PAN CARD Since I was a Citizen of India, Now I am Citizen of USA and OCI Card holder do I need to apply for the new PAN CARD? OR My old PAN CARD is going to be valid even I not did any financial activity since I moved out of India? Can you please let me know?

Living in India, my experiences showed me that it is wise to have all these "documents", hence i got my OCI/PAN/AADHAR and Driving License. Much easier now. Jai Hind :-D

I am OCI from the USA with PAN card but no Aadhar card. My mother owns several shares . She wants me to be either a joint holder with her or transfer them to me. I can't stay for six months to get an Aadhar card. What is the recourse?

Hi I am currently uk citizen, with OCI card. I was indian citizen, am born in India, lived in India till my masters degree (so more than 182days). Later I got uk citizen and visit india for 30days every year. Given I am born lived till college, do I still need to stay 182 days to get aadhar card.

My name is Bharatkumar Mody. I came to USA in 2008. I have no property in India. I have Pan card only. I have two bank accounts in Bank of baroda and State Bank of India. My Pension get deposited in both bank every month. My Accounts in both the bank are regular. Neither NRE or NRO. I left India in 2008. My bank A/C are regular in Indian style. Only my pension get deposited monthly in both banks.
Do I need to get Adhar card.? Do I apply for Adhar card ? I am USA citizen.
Please reply me. I am retired 65 years old.
I shall be grateful for your help in this matter. I am waiting for your reply.

Hello dear I am.a french citizen and oci card holder I applied for a job position but they asked for my adhaar card copy so i decided to make one but one agent told me that i would lose my french citizenship if I make an adhaar card
I asked other agents they told me that i need to renunciate my citizenship in order to get an oci card
I am totally lost ma'am could you please tell me if the information the agents gave are correct ?

I am a uk naturalised uk citizen with pan card which i applied a while ago with form 49a ( as i had adhaar card with indian adress) just realised i need to apply with 49aa as i am british citizen, do i need to change this and reapply again With right form ie 49aa?
