I understand from your statements that if the witness says that he does not know the contents of his affidavit-in-chief because they were not explained to him by his advocate then the affidavit will be thrown into the dust bin. In such situation can the witness file fresh affidavit after getting explanation of its contents?

What about Power of Attorney given to Contituent Attorney who submit the received POA without his signature to court. Further POA is the Xerox copy & not the original copy before SDO. Please advice

Sir, if the affidavit is not filed by plaintiff and the evidance is recorded by judge n signed by plaintiff to that document also.can the plaintiff ask about the affidavit n its contents? Can they inform the court that affidavit is not filed, in that case what will be the judge and courts stand.
Will the court direct plaintiff advocate to file the affidavit n proceed with cross examination again.

I filed a complaint u/s 138 NIA.The accused attended the court and accepted his liability of Rs 25 lac and signed a compromise deed before the court and requsted the court to give 45 days time to clear the amount. He paid 5 lac to me and refused to pay the remaining amount even the lapse of 65 days
Now what should I do, and also tell me about the time limit to approach the court again after the lapse of 45 days. Thanks sir
