Public offices should not become a mere housing of the ruling government interest, if democratic government has no freedom speech and expression in lives, what kind of democracy is Indian democracy. Punishment cannot be selective, the government offices needs to be fair not favouritism. If one deformation if disqualified all others, weather ruling or opposition should be dealt in the same manner, not only an opposition leader.

in many cases, the court gives conviction first and decide the punishment later. the way the law is written, conviction+2year punishment both are needed for automatic disqualification. so if the 2 year punishment is stayed, the condition for the automatic disqualification is stayed.
