Hostile Witness Vs Unfavorable Witness | How are the Two Different?

Hello and Welcome Everyone! This short video tells us the difference between Hostile Witness and Unfavourable Witness. At the Trial, both act differently. The difference is understood as 'A hostile witness is a witness, who gives evidence against the party that calls him. In such a situation, the Calling Party cross-examines his own witness with the permission of the Court under Section 154 of the Indian Evidence Act. On the other hand, an unfavorable witness is a witness, who fails to prove a fact or proves any other fact'. This difference was given in the case of Sat Paul Vs Delhi Administration 1976 Supreme Court. The Court further said that just because a person fails to prove a fact that does not make him a hostile witness and therefore cannot be cross-examined by the Calling Party.
