California’s largest business and labor groups have recently come together to strike a deal on one of the most controversial laws in California: the Private Attorney General Act, also known as PAGA.

"Attorneys fighting with companies, companies fighting back. A lot of people realized how much money they could make from it. And it became this billion-dollar industry."

When the law was passed in 2004, it was meant to deter employers from violating serious labor laws: "Wage theft, minimum wage violations, government is not doing very much about this, you can file a claim with a government and it can sit there for three years or more without it being attended to."

In today's episode, we'll look into how the PAGA law works, its growing controversy, and the recent agreement between the California Legislature, business, and labor groups to reform it. We also discuss what this new reform means for California workers and employers.

I live in Los Angeles. Everyone here keeps complaining about how bad things are then they keep voting for those bad things. They're all insane.

I’m sorry, why does the state get a bigger cut than the employees? That’s fucked up.

It is just another reason why businesses are leaving California.

ALWAYS VOTE IN YOUR LOCAL ELECTIONS...
your local government has more power over your day to day existence than the State or Federal Governments ever could.
We have got to rebuild our local governments from the very lowest levels first and then and only then should we start to work our way up from there.

I do not live in CA but I will say the amount of labor violations across the US is insanity. There is a reason why people no longer want to work & businesses are closing. I was a manager at a hotel and a previous employee was denied access to their w2, didnt pay them their last pay or the pay from the week before. The state fined the employer never paid, then the state threatened to garnish their funds the employer still didnt pay. So they were garnished. This took almost a year to resolve. In some cases it is needed. This also affected the prev employees taxes with the IRS. Employers who violates an worker needs to be sued.

I’m sure there are many lawyers out there trolling for clients. Someone will always take advantage.

Business owners in California, "the policy makers in California can't get any crazier". California policy makers, "hold my beer".

this is crazy! i use to have a business and during that time we were warned by other business owners that there was a wave of lawyers using a person with disabilities to go find businesses who did not have their property up to code with handicapped parking etc. they would threaten to sue and the business owner would settle for thousands. lawyers were making alot of money! they mainly targeted mexican restaurants

They did the same with the ADA disabilities act. Kaiser got hit hard with it, but they did have some facilities that were not ada accessible, I worked on getting them in compliance...but they also went against mom and pop stores and they don't have the money Kaiser does.

As someone who has worked retail, I Often needed to work for a 5 (Sometimes 4) hour shift, where I needed to Take a Lunch in the 4th hour, but never really wanted to.
5 Hours On-Shift, = 5.5 Hours Actual Shift bc a 30m Lunch.
IDC about a Lunch on most days, I can eat after my shift, it's only 5 hours.

I've literally worked for a bus and took a 4 hour extra shift day, and needed to take a lunch before coming back to the yard...
I could have been back at the yard in 30 minutes, and eaten anywhere I wanted, but no, I had 7-11 and Jack in the box in my area, and hit 2pm traffic on my way back adding an hour to my extra shift, pushing me really close to my 60 hour limit, and making me miss something I really wanted to go to. (This was a forced extra shift, mind you.)
