Bailiff action for business debts

When collecting for business debts bailiffs can visit your home or your business. Either way you should get written notice that they intend to visit. If you know they are likely to visit your home make sure all external doors are closed and locked. You do not have to let them in but if the doors are open they can enter. They shouldn’t climb through an open but it is best to keep them closed just in case.
If you are a sole trader or in a partnership, they can try to take goods that you personally own. This can include any business assets you have. If you trade as a limited company and it owes money, bailiffs can only take goods that belong to the company. They can still visit your home if they believe the goods are being held there. If you know that bailiffs are likely to visit your business premises try to keep all external doors and windows closed.
When a bailiff does visit they should show you their ID. Ask for it if they don’t. In most debt cases bailiffs cannot force entry into your home if they have not been in before. The rules are different for business premises but if you are worried chat with one of our advisers.
