The piece of soul does defend itself, sometimes. During the battle of the 7 Potters, Harry doesn’t cast a spell but his wand shoots out golden flames to stop Voldemorts killing curse. This is likely the horcrux in Harry defending itself.

The Baselik is a plot hole but you could argue because he’s alive and the venom, while being extremely deadly would take a short time to kill him and Fawks heals him very quickly afterwards.

And since he shares a twin core with Voldemort the horcrux doesn’t need to defend itself as they can’t fatally harm each other until Voldemort realises this in book 7 and changed wands.

When harry was avada kevra'd lily potter put a very powerful protective charm that made the curse rebound on Voldemort and a piece of voldermort had to lay on the only living thing it could find.

Self-sacrifice is the only magic powerful enough to fully protect against Avada Kedavra's fullest potential. Lily Potter had done that very thing immediately prior to the curse being cast on Harry, and that made the curse rebound on Voldemort, leaving nothing more than a magical scar. The nature of the magic, and the fact of the instability of Voldemort's soul, caused it to split his soul.

Ironically enough, Lilly's magic made Harry the safest horcrux Voldemort could possibly make. And even more ironically, Lilly's magic combined with the horcrux being there to take part of the hit gave Harry himself such strong protection that he could survive another hit 17 years down the line.

For one who has a french name, you'd think Voldemort would understand love a little more. What a shame.

Because Voldemort was too busy being discorporated to cast the protective spells, they're not innate, he was a horcrux.

Surely, you have heard that it was said that at Godric’s Hollow when Voldemort’s body was destroyed, the piece of his soul placed on Harry just “broke apart”.
The part of Voldemort’s soul latching onto Harry already explains that he is a Horcrux because a Horcrux is created when a piece of someone’s soul is contained in an alternate object (or organic life form) and the fact that he can hear the other Horcruxes proves it as well. After all, Horcruxes are connected by the creator’s soul.

I think the spell to bind it is a bit more ritualistic and involves the death part of the way through so the spell was incomplete placing the part of soul freshly torn for the spell to look for a host linking to Harry because of how incomplete it was he couldn't like it to an object of his choice and instead looked for a living vessel which wouldn't require the spells he failed to cast and resulting in the spells that protect the soul left uncast too only the ritualistic kill to severe the soul for the job and detached it for placement.

You don’t even need to read the books to answer this, the movies explain it. Lily’s protection spell deflected Voldemorts spell back at him, killing him instead, since it was the killing curse, that split Voldemorts soul one more time, that piece of his soul latched onto the only living thing in the room, thus harry becomes a horcrux. The protections on the other horcruxes are completely separate enchantments, the only trait they all share intrinsically that they contain a piece of Voldemorts soul.

Tom Riddle intended to create 6 Horcruxes, to split his soul in 7 (the part remaining in his body being the 7th). He also used deaths that were meaningful to him to create his horcruxes. At the time in question, Hallowe‘en 1981, he had created the locket, the ring, the cup, the diadem and the diary - which makes 5. The books imply that he would certainly consider the death of the one person destined to defeat him worthy of horcruxification. Now, we don‘t know how exactly it works, but I honk it is unlikely that you kill someone and then start to prepare the vessel. I would imagine you enchant the item first, then kill and merely direct the split part of your soul into the prepared item. But on October 31st, 1981, even if Voldemort had brought (and I believe he had) the intended horcrux, things went wrong. His curse, as we know, rebounded on himself, destroying his corporeal form (hard to talk of a body, isn‘t it?) and ripped his soul because he INTENDED to kill. The ripping was planned, but either the item was destroyed alongside Voldemorts body, souls tend to search for a living host (likely, as a soul can heal) or there was simply nothing the ripped part could attach to than Harry - either way, the piece of would did what it did, making Harry a living horcrux - but one Voldemort didn’t know about. He always intended to create six horcruxes, and still created Nagini, so he certainly wasn‘t aware that his intended horcrux creation was (in a way) successful.
Now about the „missing“ spells: The horcruxes were guarded by spells to protect them - at least, most of them were, the diadem was not because of his arrogance, we don‘t know about the ring, and the cup was in a high security vault at Gringott‘s while the diary was handed to Lucius Malfoy for safekeeping. The powers the items had, notably the diary and the locket, were not a result of intended spells, but manifestations of the soul fragments inside. As for Harry, he was given the gift of parseltounge, and as for Nagini, it gave Voldemort an unusual level of control, even for a Parsel.
So, Harry might not have been the intended vessel, but Tom has certainly intended, and likely prepared, his death to create his final horcrux, making Harry indeed a normal, yet accidental, and unusual, horcrux.
Really, when writing those theories, please read the effin‘ books! You get so much wrong and invalidate interesting points from the get go.

Harry was different because he had the only human part of Tom's soul. that's why when he's in King's Cross talking to Dumbledore u see that part of his soul laying under the bench. he was the accidental Horcrux.

People seems to forget that Avada Kedavra kills on impact it doesn’t create Horcrux (that’s another spell). Making a 3 split way of Voldemorts soul, the curse killing 1 part destroying the body and the Horcrux spell been ignited to protect himself from imminent death creating 2 more soul parts, one with Harry and the other surviving without a body which eventually Quirrell had. That created 9 soul parts which in magic it represents death.
