U.C. Berkeley Law Dean Erwin Chemerinsky: The Supreme Court and Racist Policing

U.C. Berkeley Law Dean Erwin Chemerinsky is one of the country's most respected constitutional scholars. In his new book Presumed Guilty, he says that the U.S. Supreme Court has allowed the perpetuation of racist policing by presuming that suspects, especially people of color, are guilty before being charged.

Dean Chemerinsky argues that the fact that police are nine times more likely to kill Black men than other Americans is no accident but rather the result of an elaborate body of doctrines. He says the pro-defendant Warren Court was a only brief historical aberration and that this more liberal era ended with Nixon’s presidency and the ascendance of conservative justices, whose rulings have permitted stops and frisks, limited suits to reform police departments, and even abetted the use of chokeholds.

Come hear Dean Chemerinsky's thoughts on necessary steps to create a more robust court system that will enhance civil rights.

He was caught violating the law as well.
Berkeley Law Dean (((Erwin Chemerinsky))) has been filmed suggesting to a class that he illegally discriminates against potential hires to boost racial diversity.

The supreme courts are built by party police and rather incompetent presidents. There is no way this should happen. The Supreme Court should be made up from peer recommendations not politicians. There must be excellence of experience as a sitting judge, gender and academic excellence.

We need to legislatively repeal Terry v. Ohio line of cases & the rest will fall into place. That needs to be the first step in police reform.

I have this on while I've got chores around the house to do so I'll come back and listen more attentively later, but I just want to say here that I'm an old white lady who nevertheless cares very deeply about this topic down to my mitochondria. The PDs and courts need to get the message that America demands that they expel their bully bigot thugs that prey on the poor and POC. Good cops and moral arbiters of justice must speak up. As things are now, we've got no business thinking that we're a civilized society.

Thank you so much for taking the time today, how do we begin the conversation regarding the grey space of national security surveillance and corporate surveillance. This is a ignored conflict of constitutional rights. The public is almost entirely unaware of the sudo surveillance state.

A brilliant discussion, both from Prof. Chemerinsky and from Brian Watt. Incisive, informative, with personal warmth and empathy even in opposition to police and government practices. Wow, I love it. *Thank you for doing this* 🏆🏆
