Scarlet Witch and quicksilver are not founding members of the avengers. They are important avengers but they were still in the brotherhood of evil mutants when the avengers were founded.

The rights to shared characters are more complicated.and I guess companies have negotiated many times. For example.Viper is a.Captain America villain., but also is related to Wolverine

In the timeline where Marvel didn't sell all it's movie rights, the company fell under, and all their characters were forgotten. In this world, the big two are DC and Valiant Comics. DC still can't figure out how to make a Superhero movie that people want to see, is good, and makes money. The highest grossing Superhero movie is *X-O Manowar 2*. People still don't know what the hell X-O Manowar is.

Another reason they can't use "mutant":

the fledgling start of Marvel Studios did a show called Mutant X; this show was created by Avi Arad. Fox was not happy about this. They sued, and won; this prompted Fox to say that no project made by other Marvel film/television properties (Avengers, Spider-Man, Hulk, etc.) could use the word "mutant" EVER again.

Thanks, Avi!

Sad thing is Fox may own the X-men but half of the characters are being "Killed" off because of the movies which makes me pissed.

I like this idea of separating as it creates diversity within marvel. and also creates a competitive edge for each brand
