Chaotic Arrest After Police Catch Them Boating Intoxicated

Officers of the Florida Fish and Wildlife Conservation Commission (FWC) were on vessel patrol in a marked FWC patrol boat. They were on the intracoastal waterway in Palm Beach County near Peanut Island when they observed a vessel traveling north at a high rate of speed (on plane) in a posted slow-speed minimum wake manatee protection zone. The vessel was later identified as [REDACTED]. The officers effected a stop for the purpose of conducting a vessel safety inspection and addressing the slow-speed violation. The occupants on the vessel were boisterous and loudly proclaiming it was Cinco de Mayo.
The officers encountered the operator, later identified as [REDACTED], and asked him to provide his registration and safety equipment. As he was looking for his registration, he had trouble staying balanced and slipped multiple times. He was asked for the safety equipment, and he pulled out some life jackets but forgot all the other safety equipment requested and stared at the officers. They had to repeat themselves multiple times before he was able to provide sufficient safety equipment. During the safety check, the officers observed possible signs of impairment: his eyes were glassy and bloodshot, he had trouble providing what was asked for even after being asked several times, and he had trouble moving about the vessel. He relied heavily on his crew to provide the items, even though they were asked not to help. Due to these signs of impairment, he was asked to put on a life jacket and come onto the officers' vessel. He sought assistance with the life jacket and then came onto the patrol boat, where the officers administered SFSTs (Standard Field Sobriety Tests).
He was read his general instructions and pre-task questions. He stated that he was wearing contacts but had no defects with his eyes and was not taking any medication or drugs. Once away from his vessel and seated near the officers, an overwhelming odor of an alcoholic beverage was immediately noticeable emanating from his person when he spoke. He stated that he had nothing to drink on this date and agreed to take the tasks. (Later in the conversation, he admitted to drinking beers.)
During the SFSTs, he was uncooperative and kept attempting to take off his life jacket. Based on the observations and his inability to perform the tasks, it was determined that he was heavily intoxicated by alcohol while operating a vessel, and he was placed under arrest. His vessel was transported to Currie Park and transferred to Sea Tow. Upon arrival at the park, he kept trying to get up and had to be told multiple times to sit down before being made to sit down. While restraining him, who continued to be uncooperative, he pushed upward, causing an officer to feel something pop in his lower back. The officer had to hold onto his life jacket with both hands to keep him seated for fear he would jump off the vessel. He was extremely hostile and uncooperative, causing injury to the officer's back, which resulted in the officer being out of work and having several doctor appointments to date.
Once Sea Tow arrived, the officers took inventory of the vessel and located two empty large bottles of hard alcohol. During the investigation, he claimed that a language barrier was the reason for his inability to pass the Standard Field Sobriety Tasks and follow directions. However, during the entire stop, he had no problems speaking and yelling in English. It was explained to him multiple times that the reason for the stop was to address the slow speed zone violation and to conduct a vessel safety inspection. During the ride back to the marina, he repeatedly asked about the reason for the stop, despite having it explained to him multiple times, and continued to argue and be non-compliant. These actions were consistent with someone who is heavily intoxicated.
He was transported to Palm Beach County Jail. On the way to the jail, he fell asleep, and upon removal from the vehicle at the jail, the entire backseat cage reeked of an unknown alcoholic beverage. At the jail, he was read his implied consent on camera and refused to submit a sample.
