Copyright law for NFTs. If you're curious about how NFTs and the blockchain might impact intellectual property rights like copyrights, then you've come to the right place. Or if you're like, "copyrights? Who cares about copyrights? We're talking NFTs!!" then you're also in the right place because if you care about NFTs then you NEED to care about copyrights, too.

I'm not an NFT expert but I am something of an intellectual property expert. So if you're curious about how NFTs and the blockchain might impact intellectual property rights like copyrights, or vice versa, then you've come to the right place. Or if you're like, "copyrights? Who cares about copyrights? We're talking NFTs!!" then you're also in the right place because if you care about NFTs then you NEED to care about copyrights, too.

Your video's give me a lot to think about. I'm just starting up two different business ventures and they are in their infancy at best. However thanks to your awesome videos it's giving me a head start on what to think about when it comes to protecting my brand(s) and how to avoid pitfalls. Your videos cover all aspects of what budding entrepreneurs should be thinking about, everything from trademarks, copyright, LLC start up, tax deductions, cookie recipes, business expenses and handy tips (one of these I may have made up...). So your videos and advice are invaluable and it's great that you post them. Burn out can be hard to avoid but I find the only real cure for burnout is to throw yourself back into your work. When you're creating, you always feel better about your business.

I got my first Copyright Certificate from the US Copyright Office Way Back in 1994. Yes, I am very old, but I take Copyrights VERY seriously. Thank you for addressing this very important topic. NFT does NOT mean Copyright. The simple ability to copy something online or with a copy machine does not mean Copyright. It is also incredibly important to think of my Wife and Family who will inherit my copyrights. Copyrights have value! Don't throw your rights away! By the way, I have found that paying a small fee for a half hour consultation with a Copyright attorney can save your financial life. Thank you SO much for addressing this important topic.

Very well-explained. Many people don't know that buying NFT is not so much different from right-clicking the file and downloading it on a computer. They don't know they are buying scam products. They think that buying NFTs is similar to or the same as buying one of a kind physical painting like the "Mona Lisa" painting. [Regarding NFTs, they are just URL links to the digital files. Those digital files are NOT stored on blockchains. They are stored separately from the blockchain. The buyers of NFTs don't own the copyrights in almost all the cases.]

Very good explanation of NFT's and copyright. Tied for first with the video that Legal Eagle did on the subject. Two great explanations, both from actual lawyers. That's not a coincidence.

I think that the different blockchains actually communicate across platforms. I think that’s part of why it’s a big deal.

A work of art is cultivated as a NFT that can be traded to a distributing company as a digitally protected asset. If it is reproduced or resold without permission then the pirate can be sued if a profit is made. If the NFT is resold the digital signature is being sold for said purposes of reproductive gain. The distributors need a royalty and auditing division to make sure the value of the NFT is tied to its income producing ability. This does not preclude the profits from royalties from a distributor contract but you gain from the control of the original work and its reproduction. The purchase of the copyright can be toed legitimately to the historical income of its reproduction value. The artist now has independence as well as the corporate entities.

I like.

VERY good video, you are very good at elaborating, that’s very valuable. Thank you! Are there any courses you would recommend on copyright law (that apply in EU)? Thanks, keep the content up :)

I’m an artist. How I wrap my head around it, is that it’s like when you travel a long way to a specific museum to get a one on one experience with say the Mona Lisa. You can see screenshot images of it all over the place online, but the camera cannot capture the exact experience of viewing it in person. People will travel countries over and pay a lot of money to have that personal experience and wait hours in a large crowd just for a chance to get close to the painting. This phenomenon in the art world is known as “aura”. All one of a kind pieces of art have aura. You can buy a COPY of the image but only one person (entity) can own and possess the original piece. An original piece of artwork is considered non-fungible. Basically people are paying millions of dollars to own the aura of an image and they are trading and selling the right to own or to claim single ownership of the image’s aura. The value of an artwork’s aura, is determined by both the artist (initially) and the audience and owners (for the remaining lifespan of the work). Property is also great example. Property offers a one of a kind experience. It has aura.

Ravencoin is a fork of bitcoin with the added feature to create assets without the need for a layer 2 or smart contract. Thanks for the content

The complexity of the topic can be further expanded by international legislation regarding different copyright handling and the varying legal weight of AI-generated works, which might have exceeded the scope of this video contribution. Nevertheless, I see the strength of NFTs precisely in these two areas. The US copyright does not apply globally. Other countries, other laws. However, blockchains can easily circumvent the resulting complexity by issuing an internationally valid form of an originator certificate. Furthermore, the currently valid forms of NFTs do not concern themselves with whether a work was created in collaboration with a generative AI and can thus fill the gap that the legislation of many countries has left open in this regard.

I don't know why but I always find it funny when a lawyer says "pisses my off". It's just better from a lawyer. 😃
