Reminder that an overwhelming majority of contracts you agree to nowadays in the US have one of these arbitration agreements. There is a bill called the FAIR Act (Forced Arbitration Injustice Repeal) that proposes to make forced arbitration illegal. Write your representatives and your senators to let them know they should be supporting this bill.

They tried doing this already in like 2018. I still have the opt-out email from that.
Whole thing has just been deja-vu for me. Surprised more people arent mentioning their previous attempts.

You need a lawyer to react to this because I’m positive this won’t hold up in an actual lawsuit. I’ve seen something similar before by a lawyer. He said something like: You can’t just have everyone sign an umbrella clause that absolves you of all lawsuits. It’s completely outside of reason.

A quick fact. It actually hurts them more unless they move their headquarters out of California. California law actually makes it so that any arbitration they get stuck with all the fees win or lose.

This ontop of the fact that Discord is planning to add Ads makes me think that someone there really likes Teamspeak and whats to see a resurgence.

I ran headfirst into this with protein powder, of all things. The inside seal described committing to arbitration. This warning was not posted on any online seller and it said you should return the product for a refund if you disagreed instead of opening it but no one would refund me. Totally sketch.

It only applies to US residents. I read the clause and it only specifies US residents and no one else. There is a section for EU residents but they're not affected, it basically boils down to "your government won't let us".

This should be illegal. In 90% of cases I’m fine with businesses doing whatever but a business shouldn’t be able to say “agree to this and I’m above the law”

Discord's original 2015 ToS included pretty much the same Arbitration clause and it included the same 30 day opt out period, though in 2015 I can't find the opt out email in the ToS.

However, their opt out email address has been provided in the ToS itself since at least 2020, contains the same 30 day out-out period, and has remained the same address (the one provided in this video).

Say whatever you want about the arbitration clauses in general, but this video made it seem like Discord is up to some new nefarious legal shenanigans when they haven't done anything legally different since their initial debut. You've also almost definitely encountered similar opt out clauses with Facebook, Google, TikTok, Whatsapp, and every other service you use regularly.
