In the world of USCIS and immigration "rejection" and "denial" are very different words. In this video we go over the definitions and provide real life examples of EB2 NIW and EB1A cases where the petitioner obtained a rejection or was denied.

Hello Oscar,

I wanted to express my gratitude for the invaluable videos you've created. They have been an immense help in preparing for my application. Given that EB1 is currently current, I'm contemplating filing for EB1 concurrently to take advantage of concurrent filing like obtaining EAD and advance parole (but in the case of deniel I want will apply for EB-2 NIW).

Could you please provide some insight into the likelihood of getting EAD and advance parole approvals prior to the decision on the I-140 (Without premium processing)? Additionally, in a scenario where the EAD and advance parole are approved but later the I-140 is denied, would the EAD and advance parole become invalid regardless of expiration date on them?

I received a rejection re payment which needs to be split. Does that mean that USCIS has already reviewed other parts in the form and has everything else apart from the individual fees for each form?

Thank you for another great video. If you use a lawyer for the I-140 application, can you self petition for premium processing after applying without using the lawyer? I re-listened to you video on it. Also, do you think premium processioning will ever be reduced to 15 days for EB 2 NIW? Thank you so much for all your helpful information.

Do you know if the filing of an I-140 by a J-1 holder would pose any issues for their J-2 dependent's reentry into the United States?

Hey Oscar
Submitted my application yesterday. I am here feeling so bad. After the prong 3, I have a page for conclusion in my petition. Then ended with “sincerely” but then I didn’t sign before writing my full legal name. I am wondering how I managed to forget this. I feel so miserable and don’t know if they’ll return my package. The uscis is meant to receive it in the next 3 days. Forms and fees were properly signed.
Please advise me😢

how long does USCIS take to send out e-notification once they've received my petition mail? Also if I forgot form ETA 9089, would they immediately reject it within a few days?

They want to charge $900 to file it no matter the timing. I should have mentioned that. Do you still think it’s better to use them?

Do you think EB2 NIW applications will be affected by the government shutdown?
