This is one of the most confusing aspects about New York State Worker's Compensation.

NY says that sole proprietors do not need to carry worker's compensation when they don't have employees.

But as soon as the sub contractor starts working for either a commercial business entity or another subcontractor they will be required to carry worker's comp otherwise the entity that is hiring them will get charged and be responsible if a claim happens.
