The key line is "I don't see this as a university problem." Summers is punting on getting involved in whether or not there is IP theft, and I'd say with good reasoning. Property theft and plagiarism are the kinds of things a university can more easily act on. Diving into the ownership of IP that the university itself has no stake in is not in scope. They'd get the same reaction from the Cambridge police...you're talking to the wrong guy.

What they got wrong was thinking it was only a Million-dollar idea when Facebook went on to become a billion-dollar business. Their academic and athletic achievements should have been enough to talk to the president of Harvard. Even if he couldn't help.
