What is Mitigation (in criminal law)?

Mitigation is NOT a defence for someone in a criminal case. It is a reasons for the Judge to consider imposing a lesser sentence than they might otherwise have done because of reasons (personal or otherwise) which the Defendant outlines. Mitigation can be accepted or rejected by the Judge.
