Hello this is expungement attorney Brian Pendergraft with Xpunge.Me, an expungement service brought to you by The Pendergraft Firm and I thought I would do a quick video on can a DUI or DWI charge be expunged in Maryland.

I believe the best answer is that it depends on the outcome of the case. If the case resulted in a not guilty, nolle prosequi, or a STET, then it is most likely eligible for expungement.

If the case resulted in a guilty plea, guilty verdict, or a probation before judgment then it is most likely not eligible for expungement under Maryland law.

DWI’s and Driving under the influence are the only crimes I can think of that a person who gets a PBJ is not entitled to a judgment after three years. The law that States this is

Keep in mind that charges for driving under the influence and driving while intoxicated are not eligible for expungement if you negotiate a probation before judgment plea with prosecutors.
