The Constitution failed to persist a limited federal government. No surprise that didn't persist a balanced branched form of government, since it wasn't able to anticipate the growth of political parties. It didn't understand that in a Republic with political parties that rather than needing to have checks and balances between different branch of federal government, that the real checks needed to be on the power of the federal government.

In short, Congress does it's best work when they are in gridlock and NOTHING gets done. New laws never fall in the people's favor.
