This video discusses objection to ConArb.
ConArb means conciliation and arbitration – which are two separate processes regarding the CCMA rules.
Conciliation is where the employer and the employee will try to mediation and settle0 the case. There will be no evidence lead and the CCMA will try to help the parties to come to an out of court settlement.
When conciliation fails – the case then goes to arbitration which is a more formal process. The involves evidence, witness testimony, documents and possibly a ruling from the CCMA.
In ConArb – the CCMA has combined the two above process to ensure speedy, effective outcomes.
According to the CCMA rules and the Labour Relations Act – an employer can objection to ConArb.
