The Armed Forces of the Philippines confirmed that four warships from China’s People's Liberation Army Navy were sighted near Onok Island in the Balabac Strait, approximately 12 nautical miles from Palawan on June 19.

For those who didn’t understand the implications; an archipelagic state like the Philippines, Indonesia and Japan can regulate passage within its internal waters. Internal waters are bodies of water in between territorial islands surrounded by connecting the baselines of the archipelago. This right is given only to archipelagic states under UNCLOS to make it simpler to defend their territory. Given that Balabac, the turtle islands. And the Sulu archipelago encircles the Sulu Sea, that means the entirety of the Sulu sea is our internal waters. The UNCLOS however mandates that special lanes should be provided by the archipelagic state for innocent passage. Innocent passage, however, depends on how the archipelagic state perceives the passage. The UNCLOS considers passage as “prejudicial” and not “innocent” if the foreign ship is threatening the use of force, doing exercises with weapons, engaging in any act of collecting information to the prejudice of the defense or security of the coastal state, any act of propaganda aimed at the state, launching, landing or taking on board of any military device, smuggling, pollution, fishing activities, research and survey activities, interfering with communications and facilities, etc.

Given that, China is already in violation of a lot of things here. The Philippines can simply accuse their military of espionage and survey activities. These passages are basically China’s way of testing how much they can get away with in the Philippines. If we wanted to, we can blockade them and make their navigation harder.

Another thing to take note of is that this is the reason why China wanted the Spratlys and Scarborough. That is so that they can have an excuse to claim that the SCS is their internal waters, thus giving them a legal excuse to blockade military ships. The only problem with that is, UNCLOS doesn’t legally consider China as an Archipelagic state unlike the Philippines and Japan. Being able to regulate internal waters is a special privilege that is granted only to archipelagic states.

Innocent Passage? Its a grey ship. Foreign military ships entering our EEZ or anyone's EEZ and going further beyond it must have follow the international protocol and that is to notify the country before their entry. Obviously we lacked white ships or even grey ones to drove those chinese grey ships. They got so near. Very near that they are already under our noses.

Wag po kayo pa tulog2 sa kangkungan, na ipinag wawalang bahala ang mga warships ng intsik na padaan daan sa ating karagatan, di nyo pa naiisip na baka kinukuha lng nila ang inyong pag ka walang bahala at inaalam kung pa ano nila tayo sasakupin ng biglaan. Kya sana nmn po wag kayo pa tulog2 na lamang mga traydor po ang mga yan. Kya sana po maging alerto tayong lahat sa mga ng yayari mapa dagat man or kakupaan.
