The individuals in the Boasberg case were non-citizens (aliens) seeking a legal review of their deportation orders based on claims of improper legal procedure or due process violations which refer us back to the case of Fong Yue Ting v. U.S. (1893)
with whether the U.S. government had the authority to expel an individual who was in the U.S. illegally.The Supreme Court upheld the government’s ability to deport illegal aliens, ruling that Congress had the constitutional authority to regulate immigration and that due process rights for illegal immigrants did not require judicial review of every case. This ruling gave the government broad authority to remove illegal aliens without requiring a formal hearing.


In conclusion, Fong Yue Ting v. U.S. (1893) is a precedent that affirms the government’s power to deport illegal immigrants without needing a formal review in court.

The Court ruled that the government (through Congress and immigration agencies) can enforce deportations without judicial interference in every case.

Therefore, while Boasberg is attempting to argue the relevance of deportation under wartime acts, it does not diminish the government's right to deport the illegal alien. The decision to turn the plane around is unwarranted and defies commonsense.
