Zarzaur Law, P.A. TV: Hiring A Lawyer Doesn’t Mean You Are Going to Court

Personal injury lawyer, Joe Zarzaur clarifies what it means to hire a lawyer and what it doesn't mean when you hire a lawyer for a personal injury case.

MISPERCEPTION
A lot of people think, “I was in a car wreck, but I don't know if I want to involve a lawyer because I don't really want to take this person to court.”

A lot of people think that if they hire a lawyer, that means that lawyer is going to immediately take them and their case to the courthouse - and that is not how it works.

HIRING A LAWYER IS NOT THE SAME AS GOING TO COURT
Hiring a lawyer is the very first step in a long process that could end in something at the courthouse, but in this business, personal injury, and wrongful death only about 2% of the cases go to trial, about 10% of the cases must go to a lawsuit stage. Most personal injury claims, 90% or so, don't ever even get filed at the courthouse.

THE JOB OF YOUR PERSONAL INJURY LAWYER – SETTLING YOUR CASE
So, the idea that your personal injury case is going to result in you going to court or somebody getting sued is unlikely. It is more likely that you are hiring a lawyer that will only negotiate a settlement with the insurance company, and never directly involving the person that caused your injury in the first place.

Except that that person is going to know all along that the lawyer is pushing on the insurance company to pay what's fair. So, the idea that you don't want to get involved in something, because it goes to court or that you don't necessarily want to sue somebody, is not your decision. The only decision you're making when you hire a lawyer after a personal injury is whether you want to even begin the process of settling your case. 90% of the time the lawyers can do that without involving the court and without suing the other party.
