sir please don't give half information - if you are selling in other then your business address state then you need gst regardless of turnover that why it is mandatory in E-commerce. there is also a big confusion that if we are using e commerce to only make sale in our state then? then also you need GST as of now but there are some news that from October you can sell in your state on e commerce without gst number. and one more point if you are taking material from some other state and selling in your state in your brand name then you need gst there also. thanks

Section 10
1.Notwithstanding anything contained in the provisions of this Act, but subject to the provisions of sub-section (3) and (4) of section 9, a registered person whose aggregate turnover in the preceding financial year did not exceed 1.5 cr (75 lakhs in case of special category of states* other than Arunachal Pradesh, Assam and Jammu and Kashmir) may opt to pay tax, in lieu of the tax payable by him under section 9, at such rates not exceeding
(a) half percent of turnover in state or union territory if he is a manufacturer
(b) 2.5% of turnover in state or union territory if he is engaged in supply if services referred to in clause b of paragraph 6 of schedule 3
(c) 0.5% of taxable turnover in state or union territory, in any other case
Provided that the person referred to in clauses (a) or (b) or (c) may supply service (other than service referred to in clause b of paragraph 6 of schedule 3) of value not exceeding 10% of turning in state or union territory
Explanation: For the purpose of 2nd proviso (I skipped first proviso because is not relevant), the value of exempt supply of services provided by way of extending loans, deposit or advances in so far as the consideration is represented by way of discount or interest shall not be considered for determining the turnover in state or union territory.
2. (a) Save as otherwise provided in sub-section (1), he is not engaged in supply of services
(b) he is not engaged in supply of goods or services or both not chargeable to tax
(c) he is not engaged in inter state supply of goods or services or both
(d) he is not supplying goods or services or both through an electronic commerce operator who is collecting tax under section 52
(e) he is not the manufacturer of following goods notified by government:
1. Edible ice whether containing cocoa or not
2. Pan masala
3. Aerated water
4. All production i.e. tobacco and manufactured tobacco substitute
5. Fly ash bricks
6. Bricks of fossil meals
7. Building bricks
8. Earthing and roofing tiles
(f) he is neither casual taxable person nor non-resident taxable person
Provided that where more than one person are having same PAN, a person shall not be eligible to opt for this scheme unless all such persons opt for the said scheme under this section
2A. Notwithstanding anything contained in the provisions of this Act, but subject to the provisions of sub-section (3) and (4) of section 9, a registered person who is not eligible to opt to pay tax under sub-section (1) and whose aggregate turnover in the preceding financial year did not exceed 50 lakh may, in lieu of the tax payable by him under section 9, opt to pay tax at rate not exceeding 3% if
(a) he is not engaged in supply of goods or services or both not chargeable to tax
(b) he is not engaged in inter state supply of goods or services or both
(c) he is not supplying goods or services or both through an electronic commerce operator who is collecting tax under section 52
(d) he is not the manufacturer of following goods notified by government:
1. Edible ice whether containing cocoa or not
2. Pan masala
3. Aerated water
4. All production i.e. tobacco and manufactured tobacco substitute
(e) he is neither casual taxable person nor non-resident taxable person
3. A person who has availed of option under this section shall lapse from the date when his turnover exceeds the limit as specified in sub-section (1), or as the case may be, sub-section (2A).
4. A person paying tax under the provisions of this section shall not collect tax on supply of goods or services or both and not be entitled to credit of input tax.
5. If a person pays tax under this section even if he is not eligible, then the proper officer may, in addition to any tax payable by him under the provisions of this, levy a penalty.
Explanation 1: For the purpose of determining the eligibility of person to pay tax under this section, supply made from 1st april of financial year till the date when such person becomes liable for registration shall be considered but the value of exempt supply of services provided by way of extending loans, deposit or advances in so far as the consideration is represented by way of discount or interest shall not be considered.
Explanation 2: for the purpose of determining liability of a person to pay tax under this section the following supply shall not be taken into account, namely:—
(a) supply made from 1st april of financial year till the date when such person becomes liable for registration
(b) the value of exempt supply of services provided by way of extending loans, deposit or advances in so far as the consideration is represented by way of discount or interest shall not be considered

*Special category of states: Arunachal Pradesh, Assam, Jammu and Kashmir, Himachal Pradesh, Manipur, Meghalaya, Mizoram, Sikkim, Tripura, Nagaland, Uttarakhand.
