I have learnt the Law related to Cheques viz Negotiable Instrument Act, 1881 and types of Cheques, difference B/w Bearer, Order, General Cross and Special Cross Cheques.
Bearer Cheque: Any body can withdraw the cash if he/she has bearer cheque in his posesion.
Order Cheque: Cash can only be withdrawn by person to whom the cheque is issued by showing CNIC.
General Cross Cheque: It cannot be cashed, it is only deposited in the A/C of the bearer or order in any Bank
Special Cross Cheque: It is also deposited in the account of addressee.
Restrictve Cross Cheque: It is deposited in A/C but in the Bank which specifically mentioned in cheque. And if CNIC of of the addressee is mentioned in cheque it would be deemed as order cheque.
Limitation for presenting of cheque is 6 months from the date of issue.

There are 3 types Cross cheques
General cross
Special cross
Restrictive cross.

Special crossing bearer can be misused only? In case if it is special crossing ordered then no issues. The main purpose of special crossing is to avoid mistakes in specific bank name.

Negotiable instrument act made 66year before of the Pakistan
Pakistan can't make own law because it's better law, order cheque and bearer cheque both are open cheque but Cnic must taken by bank for record, both are known as open cheque, Any one can cash bearer cheque, but nor order cheque, and Cross cheque can't cash on counter it's always deposited, we can crossing both bearer cheque and order cheque. General crossing and special crossing can be done in both cheque( Bearer and Order cheque )

What is meant by Open Cheque?
It has two types
1.Order Cheque
2.Bearer cheque.
Open cheque can be cashed on counter OR depositted into account. Both facilities are possible in case of Open cheque.
1. Order Cheque.Order cheque can not be cashed on counter unless CNIC matches with the name of the Cheque Holder and bank takes two signs of cheque holder before giving him cash. order Cheque cheque shall be verfied too. It can be misused in rare cases but it becomes safe when you write CNIC number alongwith name because names can be matched but CNIC numbers can not be matched ever.
2.Bearer cheque:The cheque which can be recieved by cheque holder (parkash) from the branch where account holder (Amitab) has an account, cheque holder signs two times on the back side of cheque and also submit his Copy Of CNIC for record keeping. It can be cashed by anyone else too, who brings it to the bank. i.e Cheque is on the name of Majid but it is brought to bank by Sajid, it also does not matter in bearer cheque.
Beauty Of Open Cheque is to cash on Counter.

Cross Cheque.
It is not encashed on counter
There are two cross lines over the corner of cheque . It is an special type of cheque and the bank does not need to see the name on cheque. It can not be cashed on counter but can be depositted. Cross cheque only means to not cash on counter.
General Crossing With Bearer Cheque.The General crossing with bearer cheque of Kashif ud Din can be depositted in any account.
Special cross cheque is some how secured, it becomes special cross when my client gives me cross cheque then he writes the name of bank (UBL) between two lines of cross, now i can not depositted into my other(HBL) bank account. It too can not be cashed on counter. In this way it is known as special cross cheque.
Restrictive Crossing means it is only deposited in the account of Ramesh Kumar(Account Holder) alongwith his CNIC number because it is much secure. .
Whenever cheque is bounced then within 30 days FIR can be lodged in case of cheating . It is cognizable offence and compoundable .

Section 138 of NIA 1881 defines that when you are exempted from punishment is case of dishonour of cheque.
1. Gift
2. Donation
3. Liability recording proves
4.claim of company or firm.
5.Goods defective
6. Fraud
7.Future legal liability
8. Theft goods purchased.
Financial capacity.
1. Source of income
2. Source of capacity
3. Income tax return
4.Bank account sttus
5. Withdrawn of money from bank.
If it is not cheating case then Section 138 Of NIA does not apply here.
Section 139 Of NIA defines It is presumed that itis legal liability togivethe cheque.
Section 118 of NIA defines consideration recieved, so he is bound to pay.
