Alright that was a lot really quick… here’s a quick break down of the eviction process in SC.

1. Tenant doesn’t pay rent or violates rental agreement
2. Landlord provides written notice to vacate
3. Landlord files application for ejectment in magistrate court saying why tenant should be evicted
4. Magistrate issues a rule to vacate or show cause based on allegation in landlord’s application for ejectment
5. Magistrates constable or other process server serves rule on tenant
6. Tenant has 10 days to respond
7. Tenant can vacate unit or file answer and ask for hearing with magistrate court within 10 days. Tenant should ask for a hearing whether they intend to vacate or not. (If tenant doesn’t vacate or file answer, they lose automatically)
8. At hearing, landlord has the burden to price the reason for eviction. The tenant must prove any defenses they’ve asserted.
9. If magistrate finds in favor of tenant, they aren’t evicted. If magistrate finds against tenant, magistrate will issue write of ejectment within 5 days
10. Tenant gets served writ and has 24 hours to vacate.
11. If tenant does not vacate, law enforcement conducts physical set out.

If you would stop being la, y and just pay ypur rent then you wont get evicted.
